NCDRC absolves medical negligence of ENT surgeon

A patient suffering from tonsillectomy died shortly after the procedure was conducted

The National Consumer Dispute Redressal Commission (NCDRC) has set aside the Kerala state consumer commission’s decision and dismissed a case of medical negligence against an ENT surgeon who performed a tonsillectomy on a patient who shortly died after the procedure.

The state commission held the doctor guilty of negligence and stated that the complainant will be entitled to Rs 350000 as compensation. The deceased’s wife approached the state medical council alleging medical negligence where the patient was not diagnosed with the bleeding disorder before the tonsillectomy surgery was performed on the patient which ultimately led to his death.

The doctor approached NCDRC opposing the order. The apex commission found that the state commission has erred in holding negligence on part of the doctor.
